Endangered Species Act (ESA) Consultation

   "No Effect" Determination  

PE Consultants, LLC will typically prepare a 'no effect' determination letter to the Corps no listed species are known to occur in the vicinity of the project site, appropriate Best Management Practices (BMPs) have been applied to produce no environmental changes beyond background in subject habitat, the subject action will result in no impact (adverse or beneficial) to subject listed species or their habitat (or critical habitat). 

 

   Biological Evaluation (BE)  

PE Consultants, LLC will typically prepare a Biological Evaluation (BE) as a part of informal consultation under Section 7 of the ESA when an action (project) "may affect, but is not likely to adversely affect" the subject listed species or their designated critical habitat.  PE Consultants can help to determine appropriate level of BMPs that may be applied to the project to protect the subject listed species and to avert the lengthy and complicated process of formal consultation.  Note: even beneficial impacts to subject listed species in not a 'no effect' and must undergo informal consultation. 

 

   Biological Assessment (BA)  

PE Consultants, LLC will typically prepare a Biological Assessment (BA) as a part of formal consultation under Section 7 of the ESA when an action (project) "may affect, and is likely to adversely affect" the subject listed species or their designated critical habitat.  PE Consultants can help to determine appropriate level of BMPs that may be applied to the project to protect the subject listed species and to avert this lengthy and complicated process of formal consultation. With formal consultation, the project may require negotiation with the Corps and the Services, an alternatives analysis, and the Services to prepare a biological opinion (BO) that documents whether the project will jeopardize the continued existence of the species or destroy or adversely modify critical habitat.
